BabyCare Terms of Service

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms form a binding agreement between you and Snow Bengal.

You must be at least 14 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you confirm that you have obtained the consent of your parent or legal guardian to use the Service.

You may only register and log information about a child for whom you are a parent, legal guardian, or have otherwise been granted legitimate caregiving authority.

You are responsible for:

• Providing accurate, current, and complete information when you register and updating it as necessary
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us at hanch@snowbengal.io if you suspect unauthorized access to your account

You may sign up using an email address and password, or via Apple ID or Google sign-in. You agree not to share your account credentials or transfer your account to any other person.

BabyCare provides:

• Real-time logging of baby activities (feeding, sleep, bathing, diaper changes, play, and similar activities)
• Recording of height and weight, with comparisons to standard growth curves and percentile estimates
• Statistical analysis, trends, and pattern detection
• Estimated timing for next activities, with optional push notifications
• Multi-caregiver sharing and synchronization
• Other features we may introduce from time to time

We may modify, suspend, or discontinue any part of the Service at any time. The Service is currently provided free of charge. If we introduce paid features in the future, we will provide separate notice and you will not be charged without your explicit consent.

You retain ownership of all content you input into the Service ("Your Content"), including baby information, activity logs, and notes.

You grant Snow Bengal a limited, non-exclusive, worldwide, royalty-free license to store, copy, process, transmit, and display Your Content solely as necessary to operate the Service for you — including for syncing across your devices, backup, and multi-caregiver sharing features you enable. This license terminates when your account is closed, except as necessary to (i) comply with legal obligations and (ii) maintain shared content that remains accessible to other caregivers under Section 6.

We do not use Your Content for advertising, marketing, or external disclosure beyond what is necessary to operate the Service.

You may invite other caregivers (each, a "Co-Caregiver") to share access to information about your baby. By sending an invitation, you represent and warrant that:

• You have legitimate authority over the baby's information you are sharing
• You have obtained the Co-Caregiver's consent before inviting them
• You have informed the Co-Caregiver that they will be providing their personal information to Snow Bengal upon accepting the invitation

Either you or the Co-Caregiver can revoke sharing at any time through the app's settings.

If you delete your account, baby information that you co-created with Co-Caregivers may remain accessible to them. Snow Bengal is not responsible for the accuracy, legality, or reliability of information shared between caregivers, or for any disputes that arise between caregivers.

You agree not to:

• Provide false information when registering or updating your profile
• Infringe the intellectual property or other rights of Snow Bengal or any third party
• Use another user's account without authorization
• Interfere with the operation of the Service or attempt to gain unauthorized access to our systems
• Use bots, scrapers, or other automated means to access the Service or collect data
• Register or log information about a baby for whom you are not a legitimate caregiver
• Invite a Co-Caregiver without their consent
• Use the Service in any way that violates applicable law, regulation, or public order and morals

THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

BabyCare is intended as a personal tracking tool only. The Service does not provide medical diagnosis, treatment, prescription, or professional medical advice of any kind.

Growth percentiles, next-activity predictions, statistics, trend analyses, and any other information generated by the Service are based on the data you input and are provided for informational and reference purposes only. They are not a substitute for evaluation, diagnosis, or treatment by a qualified healthcare professional.

You should consult a pediatrician or other qualified medical professional regarding any concerns about your baby's health, development, nutrition, or sleep. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE, DELAY SEEKING IT, OR DISCONTINUE MEDICAL TREATMENT BECAUSE OF INFORMATION OBTAINED FROM THE SERVICE.

If you believe your baby has a medical emergency, call your local emergency services immediately. Snow Bengal disclaims all liability for any medical or health-related decisions made based on information from the Service.

We aim to make the Service available 24 hours a day, 7 days a week, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance or system updates
• Technical issues
• Force majeure events (e.g., natural disasters, war, civil unrest)
• Disruptions to third-party services such as Google Cloud Platform or Apple Push Notification Service

We will provide advance notice of scheduled maintenance when feasible.

By you: You may close your account at any time through the app's settings.

By us: We may suspend or terminate your access to the Service, with or without notice, if:

• You violate these Terms or applicable law
• Your conduct harms the Service, other users, or third parties
• We discontinue the Service or any portion of it

Upon termination, your account information and content held solely by you will be deleted in accordance with our Privacy Policy. Information you co-created with Co-Caregivers may remain accessible to those Co-Caregivers (see Section 6).

Sections that by their nature should survive termination — including Sections 5 (Your Content), 6 (Multi-Caregiver Sharing), 8 (Medical Disclaimer), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law and Disputes) — will survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, SNOW BENGAL DOES NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• ANY DATA, PREDICTION, OR INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR RELIABLE
• THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNOW BENGAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE
• ANY MEDICAL OR HEALTH-RELATED OUTCOMES OR DECISIONS BASED ON INFORMATION FROM THE SERVICE
• DISPUTES BETWEEN CAREGIVERS WHO SHARE INFORMATION THROUGH THE SERVICE
• THE ACCURACY, LEGALITY, OR RELIABILITY OF ANY INFORMATION ENTERED OR SHARED THROUGH THE SERVICE

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Snow Bengal and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Your invitation of any Co-Caregiver without their consent or without proper authority
• Your registration or logging of information about a baby for whom you are not a legitimate caregiver
• Any content you submit, post, or transmit through the Service

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of law principles.

Informal resolution: You and Snow Bengal agree to first attempt in good faith to resolve any dispute through informal negotiation by contacting hanch@snowbengal.io.

Court jurisdiction: If a dispute cannot be resolved through negotiation within 60 days, it will be brought to the court having jurisdiction over Snow Bengal's principal place of business in the Republic of Korea, which will have exclusive jurisdiction as the court of first instance.

If you are a consumer residing in a jurisdiction whose laws prohibit certain choice-of-law or choice-of-forum provisions, the mandatory provisions of that jurisdiction's laws will apply to the extent required.

We may update these Terms from time to time. When we make material changes, we will provide notice through the app or other appropriate means at least 7 days before the changes take effect (or 30 days in advance for changes that materially affect your rights).

If you do not agree with the revised Terms, you must stop using the Service before the effective date. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Snow Bengal regarding the Service and supersede any prior agreements.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or other business transaction.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
• Notices: We may provide notices to you through the Service, by email, or by other appropriate means.
